The terms and conditions of the Saudi Gift platform are a legally binding contract between you and Saudi Gift, officially represented by Hijaz Al Madinah Trading Corporation, these terms and conditions provide protection for us, our valued customers and any visitor using this website. Please read the following terms carefully before using the Saudi Gift website.
The user agrees that access to and use of the Saudi Gift platform – in all its forms – is subject to the terms and conditions below. If you have an objection to any of these terms, please contact us before completing the registration process.
Saudi Gift Platform reserves the right to change, modify, amend, add or remove parts of the Terms of Use and Conditions at any time. Changes become effective when they are posted on the website/application without prior notice. Please check the Terms of Use and Conditions on a regular basis for all updates. Your continued use of the Site constitutes acceptance of all changes to the Terms and Conditions.
1- User Membership
You must open an account on the Saudi Gift platform to be able to use some or all of the services while complying with the conditions below:
a. Credibility
This is by providing accurate personal information. By agreeing to the list of terms and conditions, the customer acknowledges that all information disclosed by him/her is true, correct, up-to-date and complete information that reflects him/her and corresponds to what is required in the Saudi Gift registration form.
– Registration and account authentication is done via mobile phone number or email, and no member is entitled to register more than one account.
– Choose an appropriate username. You must use your full name as your account username. You may not use abusive or vulgar language or violate the intellectual property rights of any person or entity, otherwise such fraudulent behavior is a violation of the Terms and a violation of international laws and regulations.
– When setting up an online store on Saudi Gift, you must provide valid and original identification documents as specified by us (in accordance with applicable laws in the Kingdom of Saudi Arabia) and as requested by us through the Site or your store account.
b. You are responsible for your account
You are solely responsible for any activity in your account. If you share an account with other people, then the person in whose name the registration and billing information on the account is held is ultimately responsible for all activity. If you are registering a business entity, you are personally guaranteeing that you have the authority to approve items on behalf of the business. Also, your accounts are no longer transferable.
c. Protect your password
As mentioned above, you are solely responsible for any activity on your account, so it is important to keep your account password secure. If you find suspicious activity on your account, you should change your password immediately. Under no circumstances will Saudi Gift Platform be liable for any loss you may suffer directly or indirectly, morally or financially, as a result of the disclosure of your username or password information.
2- Your Content
The content you post using our Services is what we refer to herein as “Your Content” and includes anything you post using our Services (such as store names, profile pictures, listing pictures, product and merchandise images, listing descriptions, comments, ratings, reviews, videos, usernames, etc.
a. Responsibility for Your Content
You understand that you are solely responsible for Your Content. You acknowledge that you have all necessary rights to your content and that you are not infringing or violating the rights of any third party by posting it.
b/ Permission to use your content
By posting your content through our Services, you grant Saudi Gift Platform a license to use it. We do not claim any ownership of your content, but we have permission to use it to help Saudi Gift Platform to continue and develop and to be able to help promote your store and products. In this way we will not violate any rights you have in your content.
c. Reporting Unauthorized Content
Saudi Gift Platform respects intellectual property rights, and is committed to following appropriate legal procedures to remove infringing content from the Services. If content that you own or own the rights to has been published in Saudi Gift Platform services without your permission and you want to remove it, please contact the Saudi Gift Platform customer service team. If your content infringes on someone else’s intellectual property, we will remove it if we receive proper notification. We will notify you if this happens.
d. Issuing licenses or permits
E-store owners who practice a regulated profession that requires a license or permit to practice it must disclose the following:
a. Data of the professional body or institution with which the service provider is registered.
b- The applicable professional title and the name of the country in which the title was granted.
c- Any other data that Saudi Gift Platform deems important to disclose to protect the consumer.
e/ Inappropriate, false or misleading content
There are certain types of content that we do not want to publish on Saudi Gift Platform services (for legal or other reasons). You agree not to post any content that is abusive, vulgar, threatening, libelous, defamatory, or otherwise offensive or that violates our Terms and Conditions policy or any part of our Terms. You also agree not to post any content that is untrue or misleading or that uses the Services in a deceptive or fraudulent manner.
3- Prohibitions policy when you offer the product
It is forbidden to deal with the sale of both prohibited products and goods, and Saudi Gift Shop has the right to delete any prohibitions mentioned below without prior authorization to the seller:
a- Products that are counterfeit, non-original, damaged, forged, unfit for use, or that through their use can cause damage to their users either in their interests or their health.
B- Substances that are legally prohibited from circulation in the Kingdom of Saudi Arabia.
c. Publishing information, content or listing goods that (in our view) may jeopardize national security.
4- Online store sales policies
In the event that the user creates an online store on Saudi Gift, the user (which we will call here “the seller”) will be granted the store with adherence to all the terms and conditions contained in this agreement:
A- The seller is solely responsible for the correctness of the product data and its absence of violations mentioned in the items of the prohibitions policy above, honesty and honesty must be adhered to in displaying the products, and publishing the opposite may expose the seller to liability.
B- The seller must display real and private photos of the product and not display photos from the Internet or photos that are contrary to reality and truth, and any photo will be deleted if it violates intellectual rights.
C- The seller and product provider must abide by all contracts and orders concluded with other members.
D- The seller must provide all the details of the goods, describe the basic characteristics of the goods, and display the price of the goods including any additional fees or charges such as shipping fees and others.
E- The buyer and seller must agree on the most appropriate shipping or delivery method for both parties and specify the pickup time in advance and adhere to it.
F. Unless the Merchant and the Buyer agree on another period for delivery or performance of the Contract, the Buyer has the right to cancel the Contract if there is a delay in delivery or performance of the Contract for more than fifteen days from the agreed delivery date, and to recover any amounts paid under the Contract for products, goods, services or other Contract obligations affected by such delay.
G. The seller is obligated to notify the consumer of any delays or difficulties encountered that have a material impact on the performance of the contract.
H- The buyer has the right to return and refund the price of the item if he/she receives it in a form completely different from the characteristics of the product described or agreed upon at the time of purchase.
In the event of a damaged product, you must contact the seller and the Saudi Gift Platform customer service team, in order to violate one of the conditions of sale, which is to ensure that the products are safe from damage. If the product is already damaged, the defects will be mentioned when it is offered for sale in the online store.
5- Your use of our Services
We grant you a limited, non-exclusive, non-transferable, revocable license to use our Services – subject to the following terms and restrictions in particular:
a. Do not use our Services to break the law:
You agree that you will not violate any laws in connection with your use of the Services. This includes any local, provincial or international laws that may apply to you. For example, it is your responsibility to obtain any permits or licenses required by your store; you may not sell anything that violates any laws; you must abide by our sanctions policy and not engage in fraud, theft, anti-competitive behavior, threatening behavior, or any other illegal acts or crimes against Saudi Gift Platform, another Saudi Gift Platform user, or a third party.
b. Pay your bills:
You are responsible for paying all fees you owe to Saudi Gift Platform. The store owner is obligated to pay all fees owed to the platform (from COD purchases and others) at the end of each calendar month. Saudi Gift has the right to freeze the store’s services after the period specified above until the required fees are paid.
c. Do not attempt to damage our systems:
You agree not to compromise or attempt to disrupt our services, for example by distributing a virus or any malicious computer code.
6- Suspending or canceling an account
a. Suspension by you:
You can suspend or terminate your account with Saudi Gift Platform at any time from your account settings. You can get more information by contacting our customer service team. You still have to pay any outstanding invoices.
b. Suspension by Saudi Gift Platform:
We may terminate or suspend your account (and any related accounts) and your access to the Services at any time, for any reason and without prior notice. If we do so, it is important to understand that you have no contractual or legal right to continue using our Services, for example to sell or buy via our websites or mobile applications. Saudi Gift Platform may refuse service to anyone, at any time and for any reason it deems to be in the public and private interest. If you or Saudi Gift Platform terminate your account, you may lose any information associated with your account including your content.
7. Changes to the Terms
We may update these Terms from time to time. If we believe the changes are material, we will definitely notify you by doing one (or more) of the following:
a. Posting the changes through the Services
b. Sending you an email or letter about the changes.
This way you can decide whether you want to continue using the Services. Changes will be effective when posted. You are responsible for reviewing and becoming familiar with any changes. Your use of the Services after the changes constitutes your acceptance of the updated terms.
The Terms, including all policies that constitute the Terms, supersede any other agreement between you and Saudi Gift Platform with respect to the Services. If any part of the Terms is found to be non-mandatory, that part will be limited to the minimum necessary so that the Terms remain in full force and effect. Our failure to enforce any part of the Terms is not a waiver of our right to subsequently enforce that or any other part of the Terms. We may assign any of our rights and obligations under the Terms.
